Privacy Policy

Last updated: 27 October 2026

This policy explains how Upbeam ("we", "us") collects, uses and protects your personal data when you visit our website or contact us. We handle personal data in line with Kenya's Data Protection Act, 2019.

Who we are

Upbeam is a web design, business automation, business support and digital marketing business based in Nairobi, Kenya. You can contact us at skworld434@gmail.com or +254 701 873 889.

What we collect

  • Details you give us: your name, phone number, email address and any information about your business or project that you send through our contact form, text-us chat, WhatsApp, phone or email.
  • Booking details: the date and time you choose if you book a call with us.
  • Website usage: if you accept cookies, anonymous information about how you use our website, such as pages visited, device type and approximate location, collected through Google Analytics.

How we use it

  • To reply to your enquiry, call you back or hold the call you booked.
  • To prepare quotes and proposals and deliver the services you hire us for.
  • If you hire us to set up trackers, records or automation, to handle your business data only as you instruct and only for that work.
  • To send you important updates about your project or website.
  • To understand how visitors use our website and improve it.

We only send you marketing messages if you agree to receive them, and you can opt out at any time by replying "STOP" or telling us.

Legal basis

We process your data because you asked us to contact you (your consent), to take steps before entering a contract with you, to perform a contract with you, or for our legitimate interest in running and improving our business.

Who we share it with

We never sell your personal data. We only share it with trusted services that help us run our business, such as:

  • WhatsApp (Meta) for messages you send us there
  • Formspree, which delivers website form messages to our email
  • Google Analytics, only if you accept cookies
  • Our hosting and email providers

Some of these providers may store data outside Kenya. Where this happens, we rely on providers that offer appropriate safeguards for your data.

Cookies

Cookies are small files stored on your device. We only use analytics cookies if you click "Accept" on our cookie notice. If you click "Decline", no analytics cookies are set. You can change your choice any time using "Cookie settings" at the bottom of our home page.

How long we keep it

We keep enquiry details for up to 24 months so we can follow up on your request. Client records are kept for as long as needed to provide our services and to meet legal and tax requirements, then deleted securely.

How we protect it

Our website uses an encrypted connection (SSL). Access to your data is limited to the people who need it to help you, and we use secure, password-protected systems.

Your rights

Under the Data Protection Act, 2019, you have the right to:

  • Be told how your data is used
  • Access the personal data we hold about you
  • Ask us to correct or delete your data
  • Object to us using your data, including for marketing
  • Withdraw your consent at any time

To use any of these rights, email skworld434@gmail.com. If you're not happy with how we handled your data, you can complain to the Office of the Data Protection Commissioner (ODPC) in Kenya.
