Terms of Service

These terms apply when you use this website or hire Upbeam ("we", "us") for website design, development, business automation, business support, maintenance or marketing services. Each project also has a written proposal or quote. If anything in the proposal differs from these terms, the proposal applies.

1. Quotes and proposals

After our consultation we send you a written quote describing the work, timeline and cost. Work begins once you accept the quote and pay the agreed first instalment.

2. Payments

• Payments are made in stages as agreed in your quote, by M-Pesa, bank transfer or card.
• We issue an invoice and receipt for every payment.
• The website goes live once the final payment is received.
• Monthly care, hosting and marketing plans are billed in advance and can be cancelled with 30 days' notice.

3. Your responsibilities

You agree to give us the content, information and feedback we need on time, and to confirm that you have the right to use any text, photos, logos or other materials you send us. Delays in receiving content may move the project timeline.

4. Revisions

Your quote states how many rounds of design changes are included. Further changes or new features outside the agreed scope can be added and will be quoted separately.

5. Ownership

Once the project is fully paid, you own the website design, content and domain name. We may keep a copy of the work and show it in our portfolio unless you ask us not to. Third-party themes, plugins, fonts and stock images remain under their own licences.

6. Domains and hosting

Domains are registered in your name. Domain and hosting fees renew yearly or monthly as agreed. We remind you before renewals, but you are responsible for renewal payments so your website stays online.

7. Maintenance and support

Clients on a care plan receive the services described in their plan, such as backups, updates, monitoring and small edits. Work outside the plan is quoted separately.

8. Marketing results

We work hard to grow your traffic and enquiries, but results from SEO, advertising and social media depend on many factors outside our control, such as competition and platform changes. We do not guarantee specific rankings, sales or results.

9. Cancellation

You can cancel a project at any time in writing. Payments for work already completed are not refundable. We may pause or end work if payments are overdue by more than 14 days.

10. Limitation of liability

We are not liable for indirect losses such as lost profits or business interruption. Our total liability for any claim is limited to the amount you paid us for the service concerned.

11. Use of this website

The content on this website is for general information. You may not copy our designs or content without permission.

12. Governing law

These terms are governed by the laws of Kenya. Any dispute will first be discussed in good faith, and if not resolved, handled by the courts of Kenya.
